Welcome to Amara Continental Pvt. Ltd. (“Company”, “we”, “our”, “us”). These Terms & Conditions (“Terms”) govern the use of our website, products, and export services.

By accessing our website or placing an order with us, you agree to be bound by these Terms.

1. Company Overview

Amara Continental Pvt. Ltd. is engaged in the export and wholesale trade of:

  • Dehydrated vegetables (onion, garlic – flakes, kibbled, powder, granules, etc.)
  • Pigment pastes, flexible inks, colorants
  • Spices and agro commodities
  • Chemical products
  • Other related products

We supply both B2B and B2C buyers in India and internationally.

2. Use of Website

By using our website, you agree:

  • Not to misuse or damage the website
  • Not to copy, reproduce, or distribute our content without permission
  • Not to collect data or pricing using bots or scraping tools

We reserve the right to block any user violating these rules.

3. Product Information & Specifications

We ensure accurate information; however:

  • Product specifications may vary based on natural variations, crop quality, and region
  • Color, aroma, and texture may differ slightly from batch to batch
  • For pigment paste and chemicals, formulation may vary based on application requirements

Buyers must confirm specifications before placing orders.

4. Orders & Pricing

  • Prices are subject to market fluctuations (commodity rates, raw material cost, forex rates).
  • Orders are confirmed only after a formal Proforma Invoice (PI) is issued.
  • Any change in quantity, packaging, or delivery terms must be mutually agreed upon.

We reserve the right to accept or reject any order.

5. Payment Terms

Standard payment methods include:

  • Advance payment
  • Letter of Credit (LC)
  • Telegraphic Transfer (TT)
  • Mixed terms as agreed

Goods are dispatched only after receiving payment as per PI.

6. Shipping Terms (Mixed Incoterms)

We operate under EXW, FOB, CIF, CNF, DAP, and other Incoterms depending on the buyer’s requirement.

Under all Incoterms:

  • Risk and ownership transfer as per agreed Incoterms
  • Transit delays due to customs, port congestion, weather, strikes, or carrier issues are not our liability
  • Insurance responsibility depends on Incoterms (CIF includes insurance; others may not)

7. Quality Claims & Inspection

For Food Products (Onion/Garlic):

  • Slight moisture or particle variation is normal (+/- 1–2%)
  • Lab test reports shared on request
  • Claims must be reported within 48 hours of delivery with photos/videos
  • Third-party inspection (SGS, Cotecna, Intertek, BV) can be arranged at buyer's cost
  • No claims accepted once goods are used in production

For Chemicals & Pigment Pastes:

  • Shade/viscosity variations may occur within acceptable industrial tolerance
  • Buyers must test samples before bulk order
  • No claim accepted after 7 days of receipt

For All Products:

  • We do not accept claims for quality deterioration due to improper storage, humidity, heat, or delay at buyer’s end.

8. Returns & Refunds

Due to the nature of export goods:

  • No returns are accepted unless agreed in writing
  • Refunds, if any, are processed only after mutual agreement
  • Shipping charges, inspection charges, and customs duties are non-refundable

9. Delivery Timeframes

Delivery timelines are estimates only.
We are not liable for delays caused by:

  • Customs inspections
  • Port congestion
  • Shipping line issues
  • Weather conditions
  • Government regulations or restrictions
  • Logistics strikes or unforeseen disruptions

Buyers are advised to plan in advance.

10. Intellectual Property Rights

All content, including:

  • Logo
  • Product images
  • Website content
  • Brand name
  • Brochures, catalogues, designs

...is the exclusive property of Amara Continental Pvt. Ltd.

Unauthorized use, copying, or reproduction is strictly prohibited.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our liability shall not exceed the value of the order in question

12. Force Majeure

We are not responsible for non-performance due to events beyond our control, including:

  • Natural disasters
  • War, terrorism
  • Pandemic-related delays
  • Strikes
  • Government actions
  • Shipping restrictions

13. Privacy & Data Use

By submitting inquiries or orders, you consent to our use of:

  • Business details
  • Contact information
  • Transaction details

We do not sell or share data with third parties except logistics partners, labs, customs consultants, or government authorities when required.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of India.

Any dispute shall be resolved in:

Courts of Ahmedabad, Gujarat, India
